DMCA / Copyright Policy
1. PURPOSE AND SCOPE
This DMCA / Copyright Policy explains how copyright owners and authorized agents may report alleged copyright infringement involving content available through the Go Viral mobile application, website, and related services (the "Platform"), how affected users may submit counter-notifications, and how Go Viral responds to repeat infringement. Go Viral is operated by Unicorn Technologies (collectively, "Go Viral," "we," "us," or "our").
This Policy forms part of the Go Viral policy stack together with the Terms of Service, Privacy Policy, Fan Agreement, Creator Agreement, Acceptable Use Policy, and Community Guidelines.
2. CREATOR RIGHTS ATTESTATION
Every Creator upload must include an affirmative rights-confirmation before publication. By completing that confirmation, the Creator represents that the Creator owns, controls, or has all permissions and licenses necessary for the audio, video, images, text, likenesses, and other material included in the upload.
Go Viral records the rights attestation with the applicable account reference, timestamp, IP address, and audit metadata. Publication must be blocked if the required attestation is not completed.
Go Viral does not represent that upload automatically registers a work with the U.S. Copyright Office. Formal copyright registration is a separate legal process and is not performed automatically by the Platform.
3. DESIGNATED DMCA AGENT
Before public launch, Go Viral will maintain a publicly accessible designated-agent contact and will register that designated agent electronically with the U.S. Copyright Office as required for reliance on the applicable 17 U.S.C. § 512 safe-harbor framework. The registration and public listing must remain current.
Designated Agent: Copyright Compliance Department, Go Viral / Unicorn Technologies
Email: Hello@unicorntechventures.com
Mailing Address: 11000 SW 104th Street, STE 160117, Miami, FL 33116
The final public policy page must display the same legal service-provider and designated-agent information that is registered with the U.S. Copyright Office.
4. DMCA TAKEDOWN NOTICES
If you believe material available on the Platform infringes a copyright you own or are authorized to enforce, send a written notice to the Designated Agent. A notice should include substantially the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
- Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
- Identification of the allegedly infringing material and information reasonably sufficient for Go Viral to locate it, such as a post URL, content identifier, username, or other specific location information.
- Your name and contact information, including mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right allegedly infringed.
5. HOW GO VIRAL HANDLES COPYRIGHT REPORTS
Go Viral reviews copyright notices in good faith and acts expeditiously when removal or disabling of access is appropriate. For a substantially complete and valid notice, Go Viral's operational target is to process the notice within 48 hours, subject to unusual complexity, technical limitations, emergencies, legal process, or the need to obtain missing information.
- Remove or disable access to material when appropriate.
- Notify the affected user or Creator that material has been removed or disabled.
- Provide sufficient information about the claim to permit a meaningful response, while protecting information where appropriate or required.
- Preserve relevant notice, counter-notice, and enforcement records consistent with legal, security, and operational requirements.
The in-app Copyright reporting category may be used to flag content for review, but an in-app report does not replace a formal DMCA notice when the sender seeks the statutory notice-and-takedown process.
6. INCOMPLETE, ABUSIVE, OR FALSE NOTICES
If a notice does not substantially contain the information required for a DMCA notice, Go Viral may request additional information before acting. Go Viral may also take appropriate measures against users who knowingly abuse reporting systems.
Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material or activity is infringing may be liable for damages, including costs and attorneys' fees.
7. COUNTER-NOTIFICATIONS
If your content was removed or disabled because of a DMCA notice and you believe the removal resulted from mistake or misidentification, you may send a written counter-notification to the Designated Agent containing substantially the following:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location where it appeared before removal or disabling.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled because of mistake or misidentification.
- Your name, address, telephone number, and email address.
- A statement consenting to the jurisdiction of the appropriate U.S. Federal District Court as provided by 17 U.S.C. § 512(g), and agreeing to accept service of process from the original complaining party or that party's agent.
8. RESTORATION AFTER COUNTER-NOTIFICATION
After receiving a valid counter-notification, Go Viral may forward it to the original complaining party and inform that party that the material may be restored. Unless the complaining party notifies Go Viral that it has filed an action seeking a court order to restrain the user from engaging in the allegedly infringing activity, Go Viral may restore or re-enable the material in accordance with the timing required by applicable law, generally not less than 10 nor more than 14 business days after receipt of a valid counter-notification.
A person who knowingly materially misrepresents that material was removed or disabled by mistake or misidentification may be subject to liability under 17 U.S.C. § 512(f).
9. REPEAT INFRINGER POLICY
Go Viral maintains and reasonably implements a policy for terminating, in appropriate circumstances, users who are repeat copyright infringers. Go Viral may consider the number, timing, validity, severity, and surrounding circumstances of infringement notices and other reliable evidence.
Egregious or deliberate infringement may result in immediate content removal, suspension, or termination without waiting for a graduated sequence of prior violations. Enforcement does not automatically forfeit legitimate Creator earnings; financial holds, reversals, or adjustments must be supported by the applicable agreements, transaction records, fraud review, failed-delivery remediation, chargebacks, or law.
10. CONTENT PROTECTION AND ANTI-CIRCUMVENTION
Go Viral may use technical and policy controls intended to deter unauthorized copying and redistribution of protected content, including dynamic watermarking, access controls, and screenshot or screen-record detection where supported by the operating system and implementation.
Protected paid content may display a semi-transparent, tiled watermark associated with the viewing Fan's stable internal wallet identifier. Users may not bypass, disable, interfere with, or attempt to evade content-protection controls, nor redistribute paid or protected content outside the permissions granted by the Creator and Platform.
11. AUDIO AND MUSIC
Go Viral does not provide an in-app music catalog, music licensing library, Spotify integration, Apple Music integration, or other music-selection API as part of the locked MVP. Creators must prepare and license any audio included in uploaded content before publication. The Creator remains responsible for having the rights necessary for all audio embedded in the uploaded media.
12. TRADEMARK AND OTHER INTELLECTUAL PROPERTY COMPLAINTS
The DMCA process applies to copyright claims. Trademark, publicity-right, impersonation, and other intellectual property complaints may be submitted to Hello@unicorntechventures.com or through the applicable in-app reporting path. Please identify the right asserted, the material at issue, its location on the Platform, and information supporting your claim. Go Viral may request additional information before acting.
13. NO DETERMINATION OF ULTIMATE LEGAL MERITS
Go Viral administers its notice, counter-notice, content-moderation, and enforcement procedures but does not act as a court and does not make a final judicial determination of ownership, fair use, infringement, or other legal defenses. Nothing in this Policy limits rights or remedies available under applicable law.
14. POLICY ACCESS, VERSIONING, AND CHANGES
The current version of this Policy must be accessible from the Platform's Legal section, from the upload/composer flow through a contextual copyright/DMCA link, and from goviral.fans/dmca. Go Viral may update this Policy from time to time. Where the Platform requires renewed acceptance of a materially revised policy, the system may record the applicable document version, user/account identifier, and acceptance timestamp.
