Terms of Service
IMPORTANT: Please read these Terms carefully. By creating an account, accessing, or using Go Viral, you agree to these Terms and the applicable Platform Policies. These Terms include an individual arbitration agreement and class-action waiver, subject to applicable law.
1. INTRODUCTION, PARTIES, AND ACCEPTANCE
These Terms of Service ("Terms") are a binding agreement between you and Unicorn Technologies ("Go Viral," "we," "us," or "our"), operator of the Go Viral mobile application, website, and related services (collectively, the "Platform").
The Platform Policies include these Terms, the Privacy Policy, Fan Agreement, Creator Agreement, Community Guidelines, Acceptable Use Policy, Payout Policy, DMCA/Copyright Policy, and other launch policies made available through the Platform. If a Creator-specific economic term conflicts with these Terms, the Creator Agreement controls for that Creator-specific term.
Affirmative acceptance is required where presented in the signup or Creator-onboarding flow. Go Viral may record the accepting account, document/version identifier, timestamp, and related audit metadata. If a material policy version requires renewed consent, continued access to affected features may be conditioned on re-acceptance.
2. ELIGIBILITY AND AGE REQUIREMENT
You must be at least 18 years old to create or use a Go Viral account. By registering, you represent that you are 18 or older, have legal capacity to agree to these Terms, and will provide truthful information.
If we determine that an account belongs to a person under 18, we may suspend or delete the account and take the steps required by applicable law, payment-platform rules, and our policies. Any treatment of balances, purchases, or earnings will remain subject to applicable law and required refund/remediation obligations.
3. ACCOUNTS, SECURITY, AND USER STATUS
You are responsible for safeguarding your credentials and for activity under your account. Notify support promptly if you believe your account has been compromised. You may not sell, transfer, or share an account in a way that defeats Platform security or restrictions.
Every new user begins as a Fan. A Fan may apply to become a Creator through the in-app Creator onboarding flow. Creator status is governed by separate eligibility, agreement, subscription, and payout-verification states.
4. PLATFORM SERVICES AND USER-GENERATED CONTENT
Go Viral is a technology platform that enables users to publish, discover, purchase access to, message about, tip around, and interact with user-generated content. We do not guarantee that any Creator, Fan, post, live stream, message, or other user-generated content is accurate, lawful, available, or suitable for any particular purpose.
Users may report content or accounts and may block or unblock other users through supported Platform controls. We may review, restrict, remove, or disable content or accounts that violate law or Platform Policies, create safety or fraud risk, or otherwise require intervention.
Prohibited content and conduct include unlawful content; pornography or sexually explicit content prohibited by Platform policy; child sexual abuse material; content involving minors in sexual contexts; non-consensual content; harassment; threats; hate or discriminatory abuse; fraud; impersonation; malware; illegal transactions; prostitution or escort promotion; intellectual-property infringement; and attempts to evade Platform payment or security systems.
5. TOKENS AND DIGITAL PURCHASES
5.1 Token Purchases
Tokens are Go Viral digital credits used for eligible in-Platform transactions. On iOS, Token packs are sold through Apple In-App Purchase and may be surfaced or entitlement-validated through RevenueCat. Tokens have no cash value to Fans, are not withdrawable by Fans, and may not be transferred or sold outside permitted Platform functionality.
Go Viral currently offers five Token packs and may support multi-pack quantity purchases as configured in the Platform. Prices, Token counts, and available SKUs are displayed before purchase.
5.2 Refunds, Reversals, and Failed Delivery
Token purchases are generally final after delivery, subject to Apple refund or reversal rules, applicable law, fraud correction, duplicate or failed transaction correction, and Platform remediation where a paid entitlement fails to deliver. Nothing in these Terms waives a non-waivable consumer right.
5.3 Token Retirement and Breakage
Unspent Tokens may be retired upon permanent account deletion, account termination where permitted by law, twelve consecutive months of inactivity, or Platform shutdown, as described in the Fan Agreement and other Platform Policies. Unspent or retired Tokens do not create Creator payout liability because Creator liability arises only when Tokens are actually spent on a Creator-earning channel.
6. GO VIRAL ECONOMICS
The following summary reflects the current MVP economics. Creator-specific payout rights and timing are governed by the Creator Agreement and Payout Policy.
- Content unlocks below 500,000 views: 20% Platform / 80% Creator.
- Content unlocks at 500,000 views and above: 25% Platform / 75% Creator.
- Tips: 20% Platform / 80% Creator, including eligible tips from posts, messages, live streams, and Creator-to-Creator tipping.
- Go Viral Live: $0.99 per minute, charged in Tokens; 50% Platform / 50% Creator.
- Messaging: the first 500 Fan words to a Creator are free; after that, 100 Tokens per 100 words; messaging Token revenue is 100% Platform revenue and Creator replies are not charged.
- Creator subscription: $8.99 per month through Apple In-App Purchase / RevenueCat on iOS. Stripe Connect is not used to charge the Creator subscription.
The Fan-facing content-value reference is 50 Tokens = $0.99 of content face value. Creator payout conversion remains governed by the Creator Agreement and locked Platform settings.
7. CREATOR SUBSCRIPTION AND PAYOUTS
Creator status requires the applicable onboarding sequence, including Creator Agreement acceptance, the active $8.99/month Apple/RevenueCat subscription, and Stripe Connect payout/KYC onboarding where required. A lapse in the Creator subscription disables monetization tools but does not itself delete existing content or the underlying Fan account.
Creator payouts are made through Stripe Connect under the Money Monday schedule described in the Creator Agreement and Payout Policy. Go Viral does not store Creator bank-account details, SSNs, or identity-document images when Stripe hosts those verification flows. Only the minimum state needed to orchestrate payout eligibility is retained by Go Viral.
8. CONTENT OWNERSHIP, LICENSES, AND PURCHASED ACCESS
Users retain ownership of the content they upload, subject to the licenses reasonably necessary to operate, display, distribute, protect, moderate, promote, and provide purchased access through the Platform.
When a Fan purchases access to eligible Creator content, that Fan receives the personal-use entitlement described in the Fan Agreement. Individual post deletion, Creator subscription lapse, or Creator monetization deactivation does not automatically remove already-purchased Fan access where the Platform is permitted to continue providing it.
Permanent deletion of an entire Go Viral account is different. Where applicable law or Apple account-deletion requirements require removal of associated account data or user-generated content, Go Viral will delete the account and associated data not legally required to be retained. If such deletion makes a previously purchased entitlement unavailable, Go Viral may apply the failed-delivery/remediation process described in the Fan Agreement and applicable payment-platform rules.
9. COPYRIGHT AND CONTENT RIGHTS
By uploading content, you represent that you own or control the necessary rights and that the content does not violate third-party copyright, trademark, privacy, publicity, or other rights. Go Viral may remove allegedly infringing material and may terminate repeat infringers consistent with its DMCA/Copyright Policy.
Go Viral may use technical protections such as access controls, watermarking, screenshot/screen-record responses, and other anti-piracy measures. No technical measure guarantees that content cannot be copied or redistributed.
10. PROHIBITED USE AND PLATFORM INTEGRITY
- Circumventing, disabling, attacking, scraping, reverse engineering, or interfering with Platform security or services, except where expressly allowed by law.
- Bots, scripts, artificial engagement, token manipulation, fake purchases, or fraudulent payment activity.
- External-payment solicitation designed to circumvent Go Viral economics or Apple-compliant in-app purchase flows.
- Credential sharing that enables unauthorized operation of an account.
- Misleading previews, titles, or representations used to induce paid unlocks.
- Any conduct prohibited by the Community Guidelines or Acceptable Use Policy.
11. ACCOUNT SUSPENSION, CREATOR DEACTIVATION, AND DELETION
11.1 Suspension or Feature Restriction
Go Viral may suspend an account, restrict a feature, disable monetization, or hold a transaction for policy, safety, fraud, legal, or payment-compliance reasons. A restriction will be applied to the affected state where reasonably possible rather than silently deleting unrelated content or account data.
11.2 User-Initiated Permanent Account Deletion
The Platform will provide an in-app path to initiate permanent account deletion. The deletion flow may require a balance/purchase warning, a confirmation step, and entry of a confirmation word such as DELETE. Permanent deletion removes the account and associated wallet, purchases, earnings, content, and personal data that Go Viral is not legally required to retain. Unspent Tokens are retired. After deletion, the same email or supported identity credential may be used to register a new account, but prior account data is not restored.
11.3 Creator Content and Purchased Fan Entitlements
If a Creator merely deletes an individual post, cancels or lapses a Creator subscription, or deactivates monetization, already-purchased Fan entitlements may remain available as described in the Creator and Fan Agreements. If the Creator permanently deletes the entire Go Viral account and deletion law or platform rules require removal of the associated content, affected purchased entitlements may be subject to replacement, ledger correction, refund support, or other appropriate remediation.
12. PRIVACY AND DATA PRACTICES
Our collection, use, disclosure, retention, and deletion of personal information are governed by the Privacy Policy. Users should review the Privacy Policy before creating an account. Go Viral may use third-party service providers such as Apple, RevenueCat, Stripe Connect, Supabase, cloud infrastructure providers, and other vendors disclosed through the Privacy Policy or Platform interfaces.
13. THIRD-PARTY SERVICES
Third-party services may have their own terms and privacy practices. Apple controls Apple In-App Purchase billing, subscription management, and Apple refund processes. Stripe Connect controls hosted payout/KYC flows. Go Viral is not responsible for third-party outages or errors outside its reasonable control, but will provide reasonable Platform support for reconciliation of affected Go Viral states.
14. DISCLAIMERS AND LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, the Platform is provided "AS IS" and "AS AVAILABLE." We do not guarantee uninterrupted service, particular visibility, earnings, audience growth, or commercial results.
To the maximum extent permitted by law, Go Viral and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Platform. Where a liability cap is legally enforceable, total liability will not exceed the greater of the amount you paid directly for the Platform during the twelve months before the event giving rise to the claim or $100, except where applicable law requires otherwise. These limits do not apply to liability that cannot legally be limited, including fraud or willful misconduct where applicable.
15. INDEMNIFICATION
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Go Viral and its affiliates from third-party claims arising from your content, your unlawful use of the Platform, your infringement of another person's rights, or your material breach of these Terms or the Platform Policies.
16. DISPUTE RESOLUTION, ARBITRATION, AND CLASS-ACTION WAIVER
Before formal proceedings, the parties agree to attempt informal resolution for 30 days after written notice to Hello@unicorntechventures.com, unless emergency or injunctive relief is reasonably required.
Except for disputes that applicable law permits or requires to proceed elsewhere, disputes arising from these Terms or the Platform will be resolved by binding individual arbitration administered by the American Arbitration Association under the applicable consumer or commercial rules selected according to the nature of the dispute. Arbitration may occur in Miami-Dade County, Florida, remotely, or in another location required by applicable law or AAA rules. Each party waives a jury trial and participation in class or representative proceedings to the maximum extent permitted by law.
Nothing in this section prevents an eligible individual claim from being filed in small claims court or prevents either party from seeking relief that cannot lawfully be waived. Fee allocation, attorneys' fees, discovery, and remedies will follow applicable law and the governing AAA rules rather than any provision that would unlawfully burden a user's ability to pursue a claim.
17. GOVERNING LAW
These Terms are governed by Florida law, without regard to conflict-of-law principles, except to the extent another jurisdiction's non-waivable law applies. For disputes not subject to arbitration, venue will lie in the state or federal courts located in Miami-Dade County, Florida, unless applicable law requires another forum.
18. CHANGES TO THESE TERMS
We may update these Terms. Material changes will be communicated through the Platform, email, or other reasonable notice. Where a change requires renewed affirmative consent, the Platform may require acceptance of the new version before continued use of affected features. Acceptance records may identify the exact version accepted and the time of acceptance.
19. GENERAL TERMS
If any provision is unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; Go Viral may assign them in connection with a merger, reorganization, acquisition, sale of assets, or similar transaction. We are not liable for delay caused by events beyond our reasonable control.
