Fan Agreement
1. INTRODUCTION AND ELECTRONIC ACCEPTANCE
This Fan Agreement ("Agreement") is a legally binding agreement between you ("Fan," "you," or "your") and GoViral Inc. ("Go Viral," "we," "us," or "our"), the operating entity for the Go Viral mobile application and related services (collectively, the "Platform"), with Unicorn Technologies as parent company.
Every new Fan account must affirmatively accept this Agreement and the Go Viral Terms of Service before account creation is completed. The Privacy Policy must be clearly accessible from the same signup flow. Acceptance may not be pre-checked or inferred from silence. If you do not agree, you may not create or use a Fan account.
Your electronic acceptance is recorded with the account identifier, the applicable document version, and the acceptance date and time, together with any additional audit information maintained by the Platform. Material revisions may require renewed affirmative acceptance.
This Agreement supplements the Go Viral Terms of Service, Privacy Policy, Community Guidelines, Acceptable Use Policy, DMCA/Copyright Policy, and other posted Platform policies (collectively, the "Platform Policies"). If a specific transaction rule in this Agreement conflicts with a more general Platform Policy, this Agreement controls for that Fan transaction unless applicable law requires otherwise.
2. DEFINITIONS
"Content" means photos, videos, audio contained in uploaded media, live streams, replays, text, images, messages, and other material made available through the Platform.
"Creator" means a registered user who has completed the required Creator onboarding and is authorized to publish and monetize Content on the Platform.
"Fan" means a registered user who accesses Content, purchases and spends Tokens, tips eligible Creators, joins Go Viral Live, or uses Fan messaging features. Every account begins as a Fan account unless and until Creator onboarding is completed.
"Token" means a closed-loop digital credit used only within the Platform. Tokens have no cash value to Fans, cannot be withdrawn by Fans, and are not transferable outside the Platform.
"Content License" means the limited, personal, in-Platform access right described in Section 6.
"Purchases" and "Vault" refer to the in-app areas where Content unlocked by a Fan is made available for continuing access, subject to this Agreement and applicable law.
3. ELIGIBILITY, AGE GATE, AND ACCOUNT SECURITY
You must be at least eighteen (18) years old to create or use a Go Viral account. The same 18+ threshold applies to Fans and Creators. There is no parental-consent path for minors in the MVP.
Every signup method, including email, Google, and Apple sign-in, must present the 18+ age gate and date-of-birth/age attestation. Account creation is blocked if the information provided indicates that the user is under 18.
You represent that your registration information is accurate and that you have legal capacity to enter this Agreement. You are responsible for safeguarding your credentials and must promptly report suspected unauthorized access.
4. TOKENS, APPLE IN-APP PURCHASE, AND REFUNDS
4.1 Token Purchases
On iOS, Token packs and other digital purchases that are required to be purchased through Apple are processed using Apple In-App Purchase. RevenueCat may be used to validate Apple purchase receipts and entitlement events. Go Viral does not use Stripe to sell Fan Tokens inside the iOS app.
The Platform may offer the following consumable Token packs, subject to the prices displayed by Apple at the time of purchase: Spark - $1.99 / 60 Tokens; Flame - $4.99 / 160 Tokens; Blaze - $9.99 / 350 Tokens; Inferno - $19.99 / 750 Tokens; Legend - $49.99 / 2,000 Tokens. Where enabled, the app may allow purchase of multiple quantities of the same pack in a single transaction, with the total price shown before confirmation.
4.2 Token Characteristics
- Tokens have no cash value to Fans and may not be withdrawn, redeemed for cash, sold, or transferred outside the Platform.
- Fan-facing paywalls display the Token cost required for the transaction. Dollar references may appear as secondary explanatory text where appropriate.
- After a valid purchase is confirmed, Token movement within Go Viral is maintained through the Platform ledger.
- Holding unused Tokens does not create a payment obligation from Go Viral to any Creator.
4.3 Refunds, Reversals, and Failed Delivery
Token purchases are generally final once delivered to the Fan wallet, except where Apple grants or requires a refund, applicable law requires a refund or cancellation right, or Go Viral determines that a paid entitlement failed to deliver and a ledger correction or other remediation is appropriate.
Nothing in this Agreement waives a non-waivable consumer right. Apple purchase refunds and reversals are handled through Apple and may result in corresponding Token, entitlement, or ledger adjustments.
4.4 Token Retirement
Tokens do not expire while your account remains active and in good standing. Subject to applicable law, unused Tokens may be retired without cash compensation when your account is permanently deleted by you, terminated for a material violation, inactive for twelve (12) consecutive months, or when the Platform permanently ceases operations. Material changes to Token retirement rules will be communicated as required by law and Platform policy.
5. HOW FANS MAY USE TOKENS
Tokens may be spent only on Platform-authorized digital transactions, including:
- unlocking Creator Content under the Scale of Fame pricing system;
- voluntary tips to eligible Creators;
- Go Viral Live access at the Platform-set rate of $0.99 per minute, charged in the Token amount displayed by the app;
- paid Fan-to-Creator messaging after the free messaging allowance is exhausted; and
- other digital uses expressly introduced by Go Viral in compliance with applicable platform rules and the governing Platform Policies.
Creators do not set Content unlock prices or Go Viral Live rates. Platform pricing is determined by Go Viral under the applicable product rules.
6. PURCHASED CONTENT LICENSE AND VAULT ACCESS
6.1 License Grant
When you validly unlock paid Content, you receive a perpetual, non-exclusive, non-transferable, non-sublicensable, personal-use license to access that purchased Content within the Platform, subject to this Agreement, legal requirements, and the continued technical operation of the Platform.
6.2 Continuing Access
Purchased Content is intended to remain available in your Purchases/Vault on subsequent visits. If a Creator deletes an individual post, cancels or lapses the Creator subscription, or otherwise deactivates Creator monetization status while keeping the underlying Go Viral account, a copy of Content already purchased by you remains available in your Vault unless the Content must be removed for legal, safety, copyright, payment-reversal, or other required compliance reasons.
If the Creator instead permanently deletes the Creator's entire Go Viral account, Go Viral will process that deletion in accordance with applicable account-deletion and privacy requirements. Creator Content associated with the deleted account may therefore be removed from Platform systems. If that removal causes a previously purchased entitlement to become unavailable, Go Viral may provide an appropriate ledger correction, replacement entitlement, refund-support process, or other remediation consistent with Section 4.3, applicable law, and the rules of the payment platform.
Only you may permanently delete purchased Content from your own Vault while that purchased copy remains lawfully and technically available through the Platform.
6.3 Restrictions
The Content License does not give you ownership of Content or any intellectual-property rights. Unless expressly authorized by the rights holder or applicable law, you may not download, copy, reproduce, screenshot, screen-record, redistribute, sell, sublicense, publicly display, create derivative works from, commercially exploit, or transfer purchased Content or your access rights.
6.4 Content Protection
Go Viral may use access controls, screenshot/screen-record detection or blackout measures, jailbreak/root protections, and dynamic watermarking or other anti-leak controls. A watermark or similar anti-abuse identifier may use a nonpublic account or wallet identifier. Attempting to defeat these controls is prohibited and may result in suspension or termination.
7. TIPPING, MESSAGING, AND GO VIRAL LIVE
7.1 Tipping
Tips are voluntary Token transactions. Under the locked MVP economics, the Creator receives an 80% economic share of each valid tip and Go Viral retains a 20% platform share. Creator-to-Creator tipping may be permitted under the same 80% / 20% split. Creators may not tip Fans. A completed tip is generally final, subject to fraud, reversal, failed-delivery correction, Apple action, or applicable law.
7.2 Messaging
A Fan receives the first 500 words of Fan-to-Creator messaging free. After that allowance is exhausted, the rate is 100 Tokens per 100 words. Go Viral retains 100% of messaging Token revenue, and Creators do not receive a share of paid messaging. Creator-to-Fan replies are free.
7.3 Go Viral Live
Go Viral Live is offered at a Platform-set rate of $0.99 per minute. The app will display the applicable Token charge and relevant balance information before or during entry as designed. Billing begins when the Fan enters a paid live stream and ends when the Fan exits or the paid session otherwise ends according to Platform records. If a technical error causes an incorrect charge or failed entitlement, Go Viral may correct the ledger or provide other remediation consistent with Section 4.3.
8. USER-GENERATED CONTENT, SAFETY, REPORTING, AND BLOCKING
Go Viral is a creator and social platform that includes user-generated content. Sexually explicit content and nudity are prohibited. Users must comply with the Community Guidelines and Acceptable Use Policy.
The Platform provides controls to report potentially objectionable or abusive Content or conduct and to block or unblock abusive users. Reporting and blocking are separate safety actions. A blocked user may not directly interact with or message the blocking user while the block remains active, subject to the Platform's implemented block rules.
Go Viral may filter, review, restrict, suspend, remove, or preserve Content or accounts when reasonably necessary to enforce Platform Policies, respond to reports, protect users, comply with law, or protect the Platform. Published support/contact information is available through the Platform and its legal pages.
9. PROHIBITED CONDUCT
You agree not to:
- copy, capture, screen-record, screenshot, download, or redistribute Content contrary to this Agreement or applicable law;
- bypass paywalls, security controls, watermarks, content protections, age gates, or access restrictions;
- share credentials or provide unauthorized third-party access to your account, Purchases, or Vault;
- engage in harassment, threats, bullying, impersonation, fraud, spam, malicious-code distribution, or unlawful conduct;
- engage in token farming, bot activity, artificial engagement, manipulation of views, Fires, Heat, Pulse, or other Platform metrics;
- submit knowingly false reports or abuse payment-dispute procedures; or
- use the Platform to infringe copyright, privacy, publicity, or other third-party rights.
10. PAYMENT REVERSALS, CHARGEBACKS, AND FRAUD
You may dispute an unauthorized or incorrect transaction in good faith through the applicable payment provider or other lawful process. You may not knowingly misuse refund, chargeback, or dispute procedures to obtain Content, Tokens, or services without payment.
A valid refund, reversal, fraud event, or payment dispute may cause associated Tokens, entitlements, or Content access to be reversed or adjusted. Go Viral may suspend or terminate accounts involved in substantiated fraud or repeated abuse, preserve relevant records as legally permitted, and provide information to payment providers or authorities where appropriate and lawful.
11. PLATFORM ROLE, CONTENT RESPONSIBILITY, AND SERVICE AVAILABILITY
Go Viral provides the technology, pricing rules, token ledger, access controls, moderation tools, and transaction infrastructure used by Fans and Creators. Creators remain responsible for the Content they submit and for having the rights necessary to publish it.
Go Viral does not pre-approve every item of Creator Content and does not guarantee that every Creator will respond to messages or remain active. Go Viral nevertheless reserves and exercises moderation, takedown, reporting, safety, fraud-control, and legal-compliance functions as described in the Platform Policies.
The Platform and Content are provided on an "AS IS" and "AS AVAILABLE" basis to the maximum extent permitted by law. Maintenance, outages, legal obligations, moderation, or other events may temporarily or permanently affect access. Nothing in this section limits rights that cannot lawfully be waived.
12. ACCOUNT SUSPENSION, TERMINATION, AND PERMANENT DELETION
12.1 Suspension or Termination by Go Viral
Go Viral may restrict, suspend, or terminate an account for material violations of this Agreement or Platform Policies, including fraud, chargeback abuse, content redistribution, security circumvention, harassment, illegal activity, or age-policy violations. Enforcement will be administered consistent with applicable law and the Platform Policies.
12.2 Permanent Account Deletion by You
You may initiate permanent deletion of your account from within the app. The deletion flow is designed to disclose your current Token balance and purchases, ask for confirmation, and require the Final confirmation specified by the Platform before deletion is completed.
Permanent deletion removes the active account and associated personal data, wallet balances, purchase history, and user Content from Go Viral systems, except information that Go Viral is legally required or permitted to retain for a limited purpose such as tax, fraud prevention, dispute resolution, security, or legal compliance. Any legally retained record is not used to restore the deleted account. Unused Fan Tokens are retired on deletion, subject to applicable law.
If you previously purchased Content from a Creator who later permanently deletes that Creator's entire Go Viral account, the Creator's account-level deletion may require removal of that Creator's associated user-generated Content from Platform systems. In that circumstance, any resulting loss of a previously purchased entitlement will be handled under the failed-delivery and remediation principles in Section 4.3, rather than treated as a voluntary deletion by you.
After permanent deletion, the same email or supported third-party sign-in credential may be used to create a new account, but the prior account data and entitlements are not restored.
13. PRIVACY AND DATA PRACTICES
Go Viral's collection, use, disclosure, retention, security, and deletion of personal information are described in the Privacy Policy. The Privacy Policy is available from signup and from the in-app Legal/Settings area. If the Platform uses third-party services or SDKs, data sharing and protection practices are governed by the Privacy Policy and applicable platform requirements.
14. RELEASE, LIMITATION OF LIABILITY, AND INDEMNIFICATION
To the maximum extent permitted by law, Go Viral and its affiliates, officers, directors, employees, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Platform, Creator Content, or interactions with other users. This limitation does not apply where prohibited by law or to liability that cannot legally be limited.
You agree to indemnify and hold harmless Go Viral and its affiliates from third-party claims arising from your material breach of this Agreement, your unlawful misuse of the Platform, or your infringement of another person's rights, to the extent permitted by applicable law.
15. DISPUTE RESOLUTION AND GOVERNING LAW
This Agreement is governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules, except to the extent mandatory consumer law provides otherwise.
Except for matters that may lawfully be brought in small-claims court or claims for urgent injunctive relief, disputes arising out of or relating to this Agreement will be resolved by binding individual arbitration administered by the American Arbitration Association in Miami, Florida, under the applicable AAA consumer rules. To the extent permitted by law, disputes will be brought only on an individual basis and not as a class or representative action. Nothing in this section eliminates rights that cannot legally be waived.
16. CHANGES TO THIS AGREEMENT
Go Viral may update this Agreement from time to time. The current version will be made available through the Platform. Material changes will be communicated by reasonable means, including in-app notice or email where appropriate, and Go Viral may require renewed affirmative acceptance before continued use when the nature of the change or applicable law warrants it. Acceptance records are maintained by document version and timestamp.
17. MISCELLANEOUS
If any provision of this Agreement is held unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not assign this Agreement without Go Viral's consent; Go Viral may assign it as part of a merger, reorganization, asset transfer, or other lawful corporate transaction.
This Agreement and the incorporated Platform Policies constitute the agreement governing your use of the Platform as a Fan, subject to any separate Creator Agreement you accept if you become a Creator.
